1. Agreement to Terms

By downloading, installing, or using Focusmo ("the Software"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you do not have permission to use the Software.

2. License Terms

2.1 Trial Period

  • The Software offers a 7-day full-feature trial period
  • No credit card information is required for the trial
  • Trial begins upon first launch of the Software
  • After trial, software reverts to Free tier with limited features

2.2 License Types and Device Management

  • Personal License: Limited to 2 seats (devices)
  • Team License: 5-100 seats (devices) for organizations
  • Believer License: 5 seats (devices) with lifetime updates
  • Device deactivation limited to once per 30 days
  • Automatic deactivation after 90 days of inactivity

2.3 Updates and Renewal

  • Personal and Team licenses include 1 year of free updates
  • Believer license includes lifetime free updates
  • Optional renewal after 1 year at discounted rates
  • You can continue using your current version forever even without renewal

3. Privacy and Data Collection

3.1 Data Storage

  • All user data is stored locally on your device
  • No personal information is collected or transmitted
  • No account creation is required

3.2 Analytics and Usage Data

  • We collect basic usage analytics identified by a unique UUID for your device through PostHog to improve the app
  • This includes general app usage patterns, feature adoption, and performance metrics
  • We collect email addresses and link them with account and device IDs solely for in-app analytics and usage statistics
  • Email data is used only to understand user behavior patterns and improve the app experience - no marketing or external sharing
  • No session content or other personal information is collected
  • You can opt out of analytics collection in the app settings

3.3 System Integration

  • The Software integrates with system-level Do Not Disturb features
  • Window position preferences are stored in system defaults
  • No external data transmission occurs during normal operation except for optional analytics

4. Refund Policy

We offer a 30-day money-back guarantee. If you're not completely satisfied with your purchase, contact our support team within 30 days for a full refund.

Refunds beyond the 30-day period are provided at the sole discretion of Focusmo and on a case-by-case basis. Focusmo may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour.

This does not affect your rights as a Consumer in relation to Products which are not as described, faulty or not fit for purpose.

  • All refund requests will result in license deactivation
  • Contact Focusmo support for refund processing

5. Restrictions

You may not:

  • Modify, reverse engineer, or decompile the Software
  • Remove any copyright or proprietary notices
  • Transfer your license to another party
  • Use the Software for illegal purposes
  • Attempt to bypass license validation

6. Updates and Maintenance

  • Software updates are provided via Sparkle framework
  • Updates are optional but recommended
  • Technical support is provided for the current version only
  • Personal and Team licenses receive 1 year of free updates
  • Believer licenses receive lifetime free updates
  • After the update period expires, you can continue using your current version forever or optionally renew for continued updates
  • Feature availability may vary based on license tier

7. Warranty Disclaimer

The Software is provided "as is", without warranty of any kind, express or implied. The developers of Focusmo make no warranties, claims or representations and expressly disclaim all such warranties.

8. Limitation of Liability

In no event shall the developers of Focusmo be liable for any special, incidental, indirect or consequential damages whatsoever arising out of or in any way related to the use of or inability to use the Software.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes through the Software or via email.
